The rules of the road for using Fotonest.
These Terms of Service ("Terms") govern your use of Fotonest, operated by Fotonest Studio ("Fotonest", "we", "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use Fotonest. If you use the Service on behalf of an organisation, you represent that you are authorised to bind that organisation to these Terms.
You are responsible for the activity on your account and for keeping your sign-in credentials confidential. We use Google Sign-In; you must comply with Google's terms in addition to ours. Notify us immediately if you suspect unauthorised access to your account.
You agree not to:
You retain all rights in the photos and selfies you upload ("Your Content"). You grant Fotonest a worldwide, non-exclusive, royalty-free licence to host, store, process, transmit, and display Your Content solely to operate and improve the Service for you and the events you participate in.
You represent that you have the right to upload Your Content and to grant the licence above, and that Your Content does not violate any third party's rights or applicable law.
If you are a host, you are responsible for obtaining any consents required from people who appear in photos you upload, and for complying with local laws on biometric processing.
A host creates an event and uploads photos. A guest joins an event and may submit a selfie to find their photos. Hosts choose the event's visibility (public or private), capacity tier, and lifecycle. Guests can leave an event at any time.
Hosts may receive information about the guests who match within their event (name and matched photos). Hosts must use this information only to deliver event photos to the matched guest.
Some features (such as creating an event above the free tier) require payment, processed through our payment partner Razorpay. Prices and quotas are displayed at checkout. By placing an order you authorise the charge.
Because event services begin immediately on creation, payments are generally non-refundable. If you believe you were charged in error, contact us within 14 days at support@fotoneststudio.com and we will review the request in good faith.
The Fotonest name, logo, app, website, and underlying technology are owned by Fotonest Studio and protected by intellectual-property laws. Except for the limited rights granted to use the Service, no licence is granted to you in our intellectual property.
If you provide feedback or suggestions, you grant us a perpetual, irrevocable, royalty-free licence to use them without obligation to you.
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the Service. On termination, your right to use the Service ends and we may delete Your Content in accordance with our Privacy Policy.
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy of face matching, or uninterrupted availability. We do not guarantee that every photo of you at an event will be matched.
To the maximum extent permitted by law, Fotonest Studio and its affiliates are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or use, arising out of or relating to your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of (a) the amount you paid us in the 12 months before the claim, or (b) US$50.
These Terms are governed by the laws of India, without regard to conflict-of-laws principles. The courts of Bengaluru, Karnataka shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, subject to any mandatory consumer-protection rights you may have under your local law.
We may update these Terms from time to time. We will revise the "Last updated" date at the top of this page and, for material changes, give you notice in-app or by email at least 14 days before the change takes effect. Continued use after the effective date constitutes acceptance.
